COMPETITION RULES CODE ROUGE – GERARD BERTRAND

 Article 1: Organisation

SAS SPH GERARD BERTRAND (SIRET 382 338 952 0015) with a share capital of €6,000,000.00, having its registered office at Route de Narbonne-Plage 11100 NARBONNE, is organising from 15 May 2022 to 30 June 2022 a competition with a purchase requirement, with 20 prizes to be won across all points of sale.

 Article 2: Conditions of participation:

Failure to comply with the said rules will result in the automatic cancellation of the entry and any award of prizes.

 Article 3: Terms of participation:

Participation in this competition is open to all persons, excluding staff of the organising companies, service providers and partners involved in this operation, as well as their families. Le Bistrot du Pavé / Bordeaux – restaurant Le Bar du Boucher / Bordeaux – restaurant OQG / Bordeaux – Blonde Vénus / Bordeaux – restaurant Chez Mémé / Bordeaux – restaurant La Villa Loubésienne / St Loubès – Le Café Rostand / Le Haillan – Chez Peyo / Andernos – Bistro Bon / Bordeaux – l'IBOAT / Bordeaux – Hotel Etche Ona / Bordeaux – Le Bistrot du Fromager / Bordeaux Chartrons – Le Bistrot du Fromager / Bordeaux Centre – Le Robinson / Esconac – La Villa Tourny / Bordeaux), by completing the entry form associated with the purchase of a glass of Code Rouge, providing the participant's surname, first name, address, email address and telephone number before 30 June 2022.

Article 4: Running of the Competition, determination of winners and prizes:

The draw will take place on 6 July 2022, by the SCP PHILIPPE LAUTIER-THIBAUT SYLVESTRE, Huissiers de Justice Associés, 9 rue Ernest Cognac 11100 NARBONNE

All prizes must be collected no later than 31 August 2022.

Winners will be contacted by email at the address provided during registration => if no response is received before 31 August 2022, the prize is forfeited

It is not possible to exchange the prize for financial compensation.

If the winning person is unable to enjoy the prize awarded to them by the draw, they may however transfer their gift to any other person (family, friend...).

In the event of force majeure, the organising company reserves the right to replace the announced prizes with prizes of equivalent value.

Participants elect domicile at the address indicated on the form provided for in article 3 hereof.

Article 5: Legal deposit:

The rules are filed with the SCP Philippe LAUTIER-Thibaut SYLVESTRE, Huissiers de Justice Associés à NARBONNE (11100), ZAC Bonne Source, 9 rue Ernest Cognac, 11100 NARBONNE. The rules may be amended at any time in the form of an addendum by the organiser, in compliance with the stated conditions, and published at the premises of the organising company. The addendum is registered with the SCP of associated Huissiers de Justice holding the rules before its publication. It shall come into force upon publication and shall be deemed to have been accepted by the mere act of participation in the competition, from the date on which the amendment comes into force.

Any participant who objects to the amendment(s) made must cease participating in the competition.

Postal costs incurred in obtaining the rules will be reimbursed upon simple request, based on the current slow "letter" rate.

 

Article 6: Personal data:

The organising company may use this information to send institutional or commercial communications.

 

 Article 7: Disputes and liability:

Participation in this competition implies unreserved acceptance of the rules in their entirety. If one or more provisions of these rules were declared null or unenforceable, the other clauses would retain their full force and effect. Any inaccurate or false declaration, or any fraud, will result in the disqualification of the participant. The organising company shall have sole authority to resolve any dispute relating to the competition and its rules in agreement with SCP Philippe LAUTIER-Thibaut SYLVESTRE, Huissiers de Justice Associés à NARBONNE, ZAC Bonne Source, 9 rue Ernest Cognac, 11100 NARBONNE. No telephone or written request concerning the interpretation or application of these rules, the mechanisms or terms of the competition, or the list of winners will be answered. In the event of a dispute, only a registered letter with acknowledgement of receipt sent within 1 (one) month of the announcement of results will be accepted. The organising company reserves the right, should circumstances require, to shorten, extend, modify or cancel this competition in accordance with article 5 of these rules. Its liability cannot be incurred as a result.

 Article 8: Reimbursement

In the event of expenses incurred, any participant may request reimbursement of costs corresponding to the connection time to an internet access point for viewing the results. The reimbursement request must be sent by post to the competition address:

It must be accompanied by a bank account details form and supporting evidence, no later than 30 days after the competition closing date, postmark serving as proof. The costs incurred by the participant for the stamp required for this request will be reimbursed upon simple written request, based on the current slow "letter" rate. Only one reimbursement request per participant registered in the competition and per envelope (same name, same address). Incomplete requests will not be taken into account.

It being noted that, in the current state of service offerings and technology, certain internet service providers offer free or flat-rate connections to internet users, it is expressly agreed that any access to the site made on a free or flat-rate basis (such as, in particular, cable, ADSL or dedicated line connections) shall not give rise to any reimbursement, insofar as the subscription to the internet service provider's services is in such a case contracted by the user for their general use of the internet, and that the act of connecting to the site by the participant does not incur any additional costs or expenses.

 

 Article 9: Connection and use:

Participation implies knowledge and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against potential misappropriation or hacking, and the risk of contamination by any viruses circulating on the network.

The organising company declines all liability in the event of misuse or incident related to the use of a computer, internet access, maintenance or malfunction of the competition's servers, the telephone line or any other technical connection, and the submission of forms to an incorrect or incomplete address.

Article 10: Jurisdiction:

Participants are subject to French regulations applicable to games and competitions. Any dispute that cannot be settled amicably shall be referred to the competent courts designated under the Code of Civil Procedure.

Article 11: Intellectual and artistic property rights:

In accordance with the laws governing intellectual and artistic property rights, the reproduction and representation of all or part of the elements comprising this competition are strictly prohibited. The brands mentioned are registered trademarks of their respective owners.
